TERMS & CONDITIONS
1. Company Information
This Website (www.tres-tilda.com) is operated by:

2. Scope & Acceptance
These Terms govern all use of the Website and all purchases made through it.
By placing an Order, the Customer:
- Confirms acceptance of these Terms
- Declares legal capacity to enter into a binding contract
3. Orders & Contract Formation
- Product listings constitute an invitation to purchase, not a binding offer
- Orders submitted are binding offers by the Customer
- A contract is formed only upon written confirmation by the Seller
The Seller reserves the right to refuse or cancel any Order, including in cases of:
- Stock unavailability
- Pricing or system errors
- Suspected fraud or abuse
4. Pricing, Taxes & Payment
- Prices are displayed in EUR, USD, PLN and/or AED
- All applicable taxes and customs duties are included in the final price — no additional charges will be requested from the Customer upon delivery
Accepted payment methods:
- Visa, Mastercard, American Express
- PayPal, Alipay
- Apple Pay, Google Pay
Full payment is required prior to shipment.
5. Delivery & Risk
- Delivery timelines are indicative and not guaranteed
- Risk transfers to the Customer upon delivery
The Seller is not liable for delays caused by:
- Logistics providers
- Customs procedures
- Force Majeure events
6. Right of Withdrawal (EU Consumers)
Customers within the EU may withdraw within 14 days of delivery.
Conditions:
- Items must be returned unused and in original condition
- The Customer is liable for any diminished value resulting from use beyond inspection
Refunds:
- Processed within 14 days of receipt of returned goods or proof of return
- Issued via the original payment method
7. Returns & Exchanges (Commercial Policy)
TrèsTilda offers a 30-day return policy from delivery date.
- Free returns are available within the European Union only
- For all other regions, return shipping costs are borne by the Customer
Exchanges:
- Limited to size changes within the same model, subject to availability
This policy is additional to statutory rights and does not limit them.
8. Product Conformity
The Seller is liable for lack of conformity in accordance with applicable law (up to 2 years in the EU).
Remedies may include:
- Repair
- Replacement
- Price reduction
- Refund
The Seller reserves the right to determine the most appropriate remedy.
9. Luxury Goods – Use & Wear
Products sold by TrèsTilda are luxury garments requiring appropriate care.
The Seller shall not be liable for:
- Normal wear and tear
- Damage caused by improper use, storage, or cleaning
- Alterations or repairs carried out by third parties
Claims based on misuse or excessive wear will not be accepted.
10. Resale Restriction
Products are sold for personal use only.
The Customer agrees not to:
- Resell products for commercial purposes
- Distribute or export products for resale without prior written consent
The Seller reserves the right to:
- Refuse orders suspected of commercial resale
- Limit quantities per Customer
11. Chargeback & Fraud Protection
The Customer agrees to contact TrèsTilda Customer Care prior to initiating any chargeback.
In the event of a chargeback:
- The Seller reserves the right to contest the claim with supporting evidence, including proof of delivery
- Fraudulent or unjustified chargebacks may result in:
- Order cancellation
- Refusal of future transactions
- Legal action where applicable
Ownership of goods remains with the Seller until full and valid payment is confirmed.
12. Limitation of Liability
To the fullest extent permitted by law, the Seller shall not be liable for:
- Indirect or consequential damages
- Loss of profit, business, or opportunity
- Minor variations in color or appearance due to digital display
Total liability shall be limited to:
the amount paid for the Product concerned
Nothing excludes liability where prohibited by law (e.g. fraud, personal injury).
13. Indemnification
The Customer agrees to indemnify the Seller against any claims arising from:
- Breach of these Terms
- Misuse of the Website
- Violation of applicable laws
14. Refused Delivery
If a shipment is refused:
- Any operational costs incurred may be deducted from the refund
- The Seller reserves the right to withhold refunds where losses exceed order value
15. Data Protection
All personal data is processed in accordance with applicable data protection laws and the Privacy Policy.
16. Amendments
The Seller may update these Terms at any time for legal, operational, or commercial reasons.
Where required, Customers will be notified in advance.
17. Governing Law & Dispute Resolution
These Terms are governed by Polish law, without prejudice to mandatory consumer protections.
Arbitration (International & UAE Customers)
For Customers outside the EU, including the UAE:
- Any dispute shall first be resolved amicably
- Failing resolution, disputes shall be finally settled by arbitration
- Arbitration venue: Dubai, United Arab Emirates
- Language: English
- Applicable rules: DIAC (Dubai International Arbitration Centre)
This clause does not limit statutory consumer rights where applicable.
18. Severability
If any provision is deemed invalid, the remaining provisions remain fully enforceable.
19. Entire Agreement
These Terms constitute the entire agreement between the Seller and the Customer.
